When To Use
Use B109™ when an owner is hiring an architect for a multi-family residential project, apartment building, or mixed-use project that is not a condominium.
What It Does
B109 is a standard owner-architect agreement for multi-family residential and mixed-use residential projects. This agreement is based on B103 and adds a pre-design services article covering feasibility, layout, and regulatory review. It covers the full scope of architectural services from design through construction administration, addressing the specific design and administration dynamics of residential building types.
Additional Information
Not intended for residential condominium projects without modification. AIA Document B509, Guide for Supplementary Conditions to B109, includes a discussion of potential risks that may be inherent in residential condominium construction and offers model language for inclusion in B109 to better allocate these risks.
